City Ordinance No. 017- 2017

AN ORDINANCE AMENDING FURTHER SECTION 17 AND SECTION 21 OF CITY ORDINANCE NO. 013-2009, PRESCRIBING THE REQUIREMENTS FOR THE GRANTING OF FRANCHISE FOR TRICYCLES AND SETTING THE GUIDELINES FOR THEIR OPERATION IN THE CITY OF TABACO.

 

 

Be it ordained by the Sangguniang Panlungsod of Tabaco City in regular session assembled, that:

 

SECTION 1. Title – This Ordinance shall be known as “AN ORDINANCE FURTHER AMENDING SECTION 17 AND SECTION 21 OF ORDINANCE NO. 022-2002, AS AMENDED BY ORDINANCE NO. 013 SERIES OF 2009”.

 

            SECTION 2. Section 17 of Ordinance No. 013, series of 2009 is hereby further amended to read as follow:

SECTION 17. Fees. All motorized tricycles and pedicabs operating in the City of Tabaco for public utility must possess a valid franchise to operate and a Mayor’s Permit to be secured from the City Government.

  • The franchise shall be called the “Motorized Tricycle Operators Franchise” (MTOP) for motorized tricycles for hire and “Pedicab Operator’s Franchise” (POF) for pedicabs for hire and shall be a period of three (3) years. The Mayor’s Permit and other fees has to be secured annually by the operator. The MTOF, POF and Mayor’s permit shall be paid to the City treasurer’s office not later than the 15th day of March.
  • For tricycles for private use, the owner has to secure a registration permit from the City Government annually not later than the 15th day of February;
  • Each qualified applicant, whether a single proprietor, partnership, cooperative or corporation, shall be limited to a maximum of five (5) units of public utility tricycles only;
  • The City treasurer or his duly authorized representative shall collect the following fees in connection with the applicant for franchise for:

 

Motorized Tricycles:

  • Motorized Tricycle Operator’s Franchise Fee 150.00 per unit
  • Annual Supervision Fee   40.00 per unit
  • Mayor’s Permit Fee 100.00 per unit
  • Certificate of Safety and Roadworthiness 25.00 per unit
  • Sidecar Plates 115.00 per unit (the payment shall be replaced once the term of the Mayor ends and/or the plates are damaged/lost)
  • Sticker   25.00 per unit
  • Changes/Substitution/Transfer of Unit   50.00 per unit

 

 

Pedicabs for hire:

  • Pedicab Operator’s Franchise Fee 75.00 per unit
  • Annual Supervision Fee 20.00 per unit
  • Mayor’s Permit Fee 60.00 per unit
  • Certificate of Safety and Road worthiness 20.00 per unit
  • Plate Number            115.00 per unit (the payment shall be replaced once the term of the Mayor ends and/or the plates are damaged/lost)
  • Sticker 25.00  per unit
  • Driver’s Permit 30.00
  • Change/Substitution/Transfer of Unit 25.00 per unit

 

Pedicabs for Private Use (Pedal):

Types of Pedal for Private Use:

  1. Sturdy built padyak bigger wheels with wider open sidecar used in business establishments for deliveries of cements, iron bars, and other merchandises;
  2. Second and Third types are ordinary pedaled tricycle with canopy and BMX bike attached with open sidecars, both for private passengers services.

For Type One, registration fees shall as follows:

1.) Registration Fee                                          40.00 per unit

2.) Certificate of safety & road worthiness         20.00 per unit

3.) Annual supervision fee                                 20.00 per unit

4.) Plate number                                               30.00 per unit

5.) Sticker                                                         25.00 per unit

6.) Change/Substitution/Transfer unit                 25.00 per unit

7.) Driver’s Permit                                            30.00

 

For Types Two and Three, the fees shall as follows:

 

  • Registration Fee 40.00 per unit
  • Plate Number 30.00 per unit
  • Sticker 25.00 per unit
  • Driver’s Permit 30.00

 

  • Any registered Tricycle operator who fails to renew Mayor’s Permit on or before the March 15 deadline shall automatically mean cancellation of his franchise.

 

  • A twenty five (25) percent surcharge on Mayor’s Permit and supervision fees will be imposed on late registration of units.

 

SECTION 3. Section 21 of Ordinance No. 022-2002 is hereby further amended to read as follows:

SECTION 5. Effectivity Clause. This Ordinance shall take effect upon its approval.
