AN EXECUTIVE ORDER DEPUTIZING CERTAIN IDENTIFIED GOVERNMENT AND NON-GOVERNMENT PERSONNEL AND PERSONS AS SMOKE FREE ENFORCERS OF TABACO CITY

WHEREAS, City Ordinance No. 019-2011 otherwise known as the “Smoke Free Ordinance of Tabaco City provides sanctions and penalties to violators and non-compliant establishments;

WHEREAS,the enforcement of the Anti-Smoking laws, rules and regulations will be enhanced through Deputized Smoke Free Enforcers;

NOW THEREFORE, by virtue of the power vested upon me by section 455, b, 2, ii of R.A. 7160, otherwise known as the local government code of 1991, I, CIELO KRISEL LAGMAN-LUISTRO, City Mayor of Tabaco City, do DEPUTIZE the BELOW LISTED GOVERNMENT AND NON-GOVERNMENT PERSONNEL AND PERSONS AS SMOKE FREE ENFORCERS OF TABACO CITY and ORDER the following:

1. Powers and Functions. The Deputies shall exercise and perform the following powers and functions:

1. Subject to government accounting system, the Deputies shall be issued Smoke Free Citation Tickets by the City Treasurer.
2. Apprehend violators and non-compliant establishments through the issuance of Citation Tickets.
3. Assist the City Treasurer in coordination with the City Legal Office in the filing of cases against non-paying violators and non-compliant establishments.
4. Be entitled to appropriate police assistance in the performance of their functions.
5. Wear approved insignia and identifications.

Repealing clause.  All local orders, directives and issuances or parts thereof which are inconsistent with this executive order are hereby repealed and modified accordingly.
